How Should We Put Up A New Fence Against A Neighbor's Yard If The Dirt Is A Foot Higher On Their Side?

We have a fence that's gotten old and worn out. We plan to replace it, but a neighbor has used it to hold their dirt. The dirt is more than a foot higher on their side than on our side in some places. The cost of replacing the entire fence is high, and we don't want it to be ruined by the pressure of the dirt. What are some options? Placing the new fence higher than the existing one and allowing dirt/mud to run off into our yard? Other ideas? Thanks.
